Terms of Service

1. Service description

Smelt Cloud provides dedicated bare-metal infrastructure (servers) on a subscription basis. Each compute node includes a guaranteed performance floor (CPU cores, RAM, storage, bandwidth, and network) as advertised on our pricing page. We may use underlying hardware from any qualified vendor to meet or exceed the advertised specifications.

2. Acceptable use

Bare metal nodes ship with Flatcar Container Linux and full root access. Managed Kubernetes nodes include a single-tenant RKE2 cluster with dedicated control plane and cluster-admin access. Custom OS installations are not supported; all nodes run Flatcar. You may deploy any workload compatible with your chosen tier. You may not: resell raw server access, engage in illegal activity, send unsolicited bulk email, operate DDoS infrastructure, or use the service in violation of applicable laws.

3. Payment terms

Founding commitments require a card on file; the card is validated but not charged until the deployment activates. Prepaid terms (annual, 3-year) are billed upfront and are non-refundable except as required by law or as otherwise stated in your agreement. Month-to-month service is billed in advance.

4. Service level agreement

We target 99.9% uptime per calendar month, backed by service credits. See your service agreement for the exact credit schedule.

5. Limitation of liability

Our liability for any claim is limited to the amount you paid for the affected service in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

6. Termination

You may cancel month-to-month service at any time. Prepaid terms run for their full committed length unless terminated for material breach.
